A valid flight number is required for all premium vehicles.
For those arriving by plane, train, or any other means that can prove their tourist destination, we require proof of your current address in Málaga, such as a rental agreement or an electricity, gas, or water bill that is less than 2 months old. You must also provide the full address of the rental vehicle you will be traveling to.
If you do not bring any of these documents that prove your residency, we will not be able to deliver the vehicle to you.
Included in the rental price:
- VAT, local taxes, and fees.
- Passenger car insurance
- Two-hour courtesy window to return the vehicle.
- Direct Return Service: The vehicle must be returned with the same amount of fuel as when it was picked up.
- Additional Driver: The first additional driver will be included.
- Travel Insurance: Vehicles provided by Easy Rent a Car Marbella may only circulate within the Peninsula. Iberia, including Gibraltar and Portugal, and must be returned to our Marbella offices.
- Full Damage Insurance: This insurance covers damage to wheels, windows, clutch, landing gear, battery, towing, fuel errors, and key loss.
Not included in the rental price:
- After-hours: You have the option to pick up your vehicle at any time, 24 hours a day. However, vehicles picked up between 11:00 PM and 7:00 AM, outside of normal office hours, will incur an additional charge of €35 per vehicle. Reservations outside of regular office hours, i.e., between 11:00 PM and 7:00 AM, will only be processed at our Malaga Airport office, and it is essential that you provide your flight number.
- One-way: If the reservation is for less than 3 days and the pick-up office is different from the destination, you will be charged €35, which will be automatically added at the end of the booking process, showing the total price including this extra.
- Additional Driver: Additional drivers can be added, and they will be equally covered by insurance. However, there will be an additional charge of €6 for each additional driver, up to a maximum of 3 additional drivers per Rental Agreement (minimum €12 and maximum €72 for each). All Clients and/or authorized drivers will be jointly and severally liable for all Client obligations arising from the agreement and the laws applicable within said agreement.
- Baby/child seats and booster seats: 2.25 euros per day for each seat delivered and per contract (minimum 13.5 euros and maximum 54 euros for each). Installation of these will always be the Client’s responsibility.
In the event of an accident or damage to the vehicle, the customer is required to complete an accident/damage report and submit it to our office. Likewise, in the event of theft of the vehicle, the customer is required to report it to the police and submit the report to our office, as well as return the vehicle key.
For each accident or damage report that Easy Rent a Car Marbella has to process, an additional €50 (VAT included) will be charged for the accident processing. If the insurance determines that the incident was not the Client’s responsibility, the €50 (VAT included) will be refunded.
Easy Rent a Car Marbella reserves the right to modify any of the above points if deemed necessary to ensure the safety of the vehicle.
Purpose of the rental agreement
The rental of a car is not necessarily linked to a particular vehicle, but rather to a group of similar vehicles with similar technical and comfort characteristics.
The Client acknowledges receiving the vehicle as described in the contract, clean and with the maintenance and operating conditions, damage, fuel level, and auxiliary equipment specified. If no reference is made to the vehicle, it will be considered suitable for use.
Term of the agreement
The duration of the The Rental Agreement will appear on the front, specifying the date and time of delivery and return of the vehicle.
A rental day refers to a 24-hour period from the date of release of the rental plus a 120-minute grace period for the return of the vehicle.
The maximum duration of the Rental Agreement will be 60 days.
If the Customer decides to terminate the rental before the date specified in the Rental Agreement, they will not be reimbursed for the early return.
Additionally, if Easy Rent a Car Marbella unilaterally terminates the rental before the date specified in the Rental Agreement for reasons not attributable to the lessee, and formally requests the return of the vehicle and it is delivered to them, the Customer is entitled to receive compensation from Easy Rent a Car Marbella in an amount corresponding to double the amount paid for the remaining days the vehicle was still in use under the Rental Agreement.
Use of the Vehicle
The Customer agrees to keep the vehicle in good condition and, in particular, without prejudice to any obligations that may be contained in other provisions of this Rental Agreement, such as:
- Use and operate the vehicle diligently, respecting the Traffic Laws, Motor Vehicle Circulation, Road Safety Measures, and all applicable regulations. Any damage to the rental vehicle caused by negligence or failure to comply with the rules will not be covered by insurance.
- Without limiting the generality of the provisions in the preceding paragraph, the vehicle may not be driven under the influence of alcohol, narcotics, psychotropic drugs, stimulants, or other similar substances, or in a state that impairs driving ability, such as fatigue or illness, nor may the vehicle be driven by someone in a similar state.
- Do not use the vehicle for illegal purposes.
- Do not allow the vehicle to be driven by anyone other than the Customer or the additional drivers specified on the main page of the Rental Agreement.
- Do not carry more passengers than specified by the vehicle manufacturer or permitted by law, nor transport animals.
- Do not use the vehicle to move, push, or tow other vehicles, trailers, or objects.
- Do not drive on roads or other places that, due to their poor condition, could cause damage to the vehicle. vehicle.
- Do not use the vehicle in competitions, contests, training, or endurance tests for automotive materials, accessories, or products.
- Do not use gasoline or other fuel of a certain quality or with characteristics that are not appropriate or do not meet the manufacturer’s specifications for each type of vehicle.
- Park and lock the vehicle properly when not in use.
- Do not use the vehicle to load or transport goods of any kind, nor install a roof rack without authorization.
- Do not tamper with the vehicle’s odometer in any way.
- Do not use the vehicle for public passenger transport, driving lessons, courier services, the delivery of goods, commercial or industrial activities, or any activity that involves subleasing the vehicle.
- Do not transfer the vehicle outside the Iberian Peninsula (excluding Gibraltar and Portugal) unless prior written authorization has been obtained from Easy Rent a Car Marbella to do so.
- The Customer must have held a valid driving license in Spain for a minimum period of one year prior to the rental. The Customer is directly responsible for these acts, thus maintaining Easy Rent a Car Marbella‘s indemnity under any circumstances.
The Customer is directly responsible for any damage to the vehicle or to third parties in the event of misuse of the vehicle.
Any act that violates the provisions of this Rental Agreement will be construed as misuse of the vehicle, in which case the Customer will be responsible for all damages caused to the vehicle, as well as any damages or losses caused to Easy Rent a Car Marbella.
Vehicle Return
The vehicle will be returned to the office, on the date and time stipulated in the Rental Agreement. The vehicle will be returned by the Customer in the same condition as when it was rented, along with all documentation, auxiliary equipment, tires, tools, and accessories.
The Customer may not alter any of the vehicle’s technical characteristics, keys, equipment, tools, and/or accessories, nor modify its exterior and/or interior. If this is done, the Customer will bear all necessary expenses to return the car to its original condition, without prejudice to any damage caused to Easy Rent a Car Marbella resulting from the reconditioning of the car during the time it must be immobilized, as well as any other damage caused to Easy Rent a Car Marbella.
Late return/delivery of the vehicle: If the vehicle is returned by the Customer on any date, time, or place other than that specified in the Rental Agreement, an additional rental day will be charged at the current daily rate for each day or part of a day that the vehicle is returned late. A grace period of 120 minutes is allowed for returning the vehicle beyond the scheduled return time. Likewise, a penalty of 35 euros will be charged for each day that the return is delayed.
If the Customer returns or leaves the vehicle in a location other than that specified in the Rental Agreement, Easy Rent a Car Marbella may require reimbursement of expenses incurred for transfers, towing, tolls, storage, or custody.
If Easy Rent a Car Marbella is delayed in returning the vehicle for more than 120 minutes from the signing of the Rental Agreement, the Customer will be compensated with an additional day at the current daily rate for each day or portion of a day that the return of the vehicle is delayed. Likewise, a penalty of 35 euros will be charged for each day of delay.
Extension of the Rental Contract
If the Customer wishes to extend the rental period, they may do so in person at any Easy Rent a Car Marbella office to sign the extension and make the appropriate payments. This extension is subject to vehicle availability. No rental contract can be extended by phone, email, or text message.
A unilateral extension by the Customer will be considered unauthorized use of the vehicle for the purposes of the Customer’s liability for any damage to the vehicle and will also be treated as a failure to return the vehicle at the agreed time.
Vehicle and Fuel Return Process
The vehicle return process includes verifying that the vehicle is returned in its original condition. To do this, Easy Rent a Car Marbella technicians perform a management check in which two elements will be verified: the condition of the car in terms of any damage it may have suffered during the rental period, the fuel level, and the mileage.
A – Vehicle Condition
The vehicle must be returned by the Customer in the same condition as it was delivered. Our staff will inspect the vehicle’s condition and note any new damage. You will be asked to consent to and sign a damage inspection report.
If the vehicle is not returned in the same condition, the Customer will also be required to compensate for any downtime the vehicle may have suffered as a result of the damage suffered. Please see the “Vehicle Return” section.
B – Fuel
The vehicle must be returned with the same amount of fuel as when it was picked up.
If the vehicle is returned with less fuel, the amount corresponding to the missing fuel will be charged at that time.
C – Mileage
If you are traveling more than 2,000 km during your reservation, you will need to come to our office to exchange your car. Otherwise, we will charge €2 per kilometer exceeded.
Payment
- Accepted payment methods are Visa or MasterCard credit cards.
- Maestro or Electron debit cards will not be accepted.
- Payments with Diners Club, American Express, or Postepay will not be accepted.
- Prepaid or virtual cards will not be accepted.
- Payment by cash, smartphone, bank check, or bank transfer will not be accepted.
- The cardholder of the bank card used to pay for the rental must be the contract holder, and the contract holder must be present at the time of car pick-up.
- Only one bank card may be used per contract, and it must be in the name of the cardholder.
- The cardholder, who will be the same as the contract holder, will be responsible for paying any extras caused by additional drivers on the contract.
- The payer is responsible for knowing the bank card PIN if paying with a card that includes this technology.
- The payer must ensure that their bank card has sufficient funds at the time of vehicle pick-up to cover the rental costs with all contracted options and also, if applicable, block the pre-authorization amount for the rental vehicle group.
- In the case of special and premium vehicles, two credit cards will be requested to guarantee the rental.
At the time of vehicle pick-up and rental payment, Easy Rent a Car Marbella will collect the rental costs, payable at the counter. bank card of the contract holder.
The following will be the responsibility of the Client and, therefore, charged by Easy Rent a Car Marbella:
- Fines: The Client is responsible for paying fines for traffic violations, illegal parking, or other violations that have occurred during the rental period of the vehicle and during the time the Client has possession of the rental vehicle until the actual return of the vehicle. Easy Rent a Car Marbella will charge an amount of 30 euros (VAT included) as management and processing fees, as it is obliged to inform the relevant authorities and provide them with the Client and rental contract details within the established legal deadline. This fee does not include payment of the fine.
- Loss of keys: Key replacement is included in the insurance, but shipping costs will be borne by the Client. Costs start at €30.
- Special vehicle cleaning: The rental price includes a standard vehicle cleaning. However, if the vehicle requires special cleaning due to having been returned in an inadequate condition, Easy Rent a Car Marbella will be required to charge an amount of up to 150 euros.
- The Customer is solely responsible for the cost or difference in value of any spare wheels, tires, tools, accessories, documentation, keys, or radio equipment that, at the end of the rental period, are missing from the vehicle or are replaced, depending on the circumstances. These circumstances are not expressly covered by any insurance policy.
- The costs of repairing damage to the vehicle in the event of an accident, when:

- The vehicle was not used in accordance with the established conditions of use.
- The accident report was not completed and sent to Easy Rent a Car Marbella within the stipulated period or did not correspond to the reality of the facts presented.

How to cancel your reservation with online payment
- If the reservation is canceled more than 48 hours before the vehicle pickup time, all charges will be refunded.
- If the reservation is canceled less than 48 hours before the pickup time, no money will be refunded.
- If this is a non-refundable offer, no refund is possible.
Insurance
The Client and any other authorized drivers are insured under the Automobile Insurance Policy, a copy of which is available at any Easy Rent a Car Marbella office where vehicles are rented. This policy includes Civil Liability for damages to third parties arising from the use and operation of the vehicle.
In addition, damage to the vehicle in the event of a collision, theft, accidental fire, or vandalism will be covered provided the following conditions are met:
- The Client notifies Easy Rent a Car Marbella of the incident within 24 hours and provides the necessary documentation, such as: a completed accident report signed by both parties, information on possible witnesses, a report to the authorities, etc.
- The insurance company does not reject the claim, alleging that the driver did not meet the physical and psychological conditions required by the Highway Code.
- The incident was not caused by misuse of the vehicle.
The insurance will cover damage to wheels, windows, clutch, undercarriage, battery, towing, fuel errors, and key loss. These coverages and guarantees will only be valid if the Client meets the conditions established above for damage to the vehicle itself.
The Client agrees to immediately inform Easy Rent a Car Marbella of any accident that has occurred or damage caused to the rental vehicle, to immediately forward any letters, summonses, or notifications related to the incident, and to fully cooperate with Easy Rent a Car Marbella and the insurance company during the investigation and defense of any claim or lawsuit. It is mandatory for the Client to duly submit the accident or damage report within a maximum of 24 hours after the event. In particular, if an accident occurs, the Client will take the following measures:

- Obtain complete details of the persons involved in the accident, as well as any witnesses, a sketch of the accident, and the details of the other vehicle (license plate, model, insurance company and policy number, etc.).
- Transmit the acquired data referred to in the previous paragraph and any other details relating to the accident to the Lessor as soon as possible.
- Immediately notify the authorities if the other party is at fault and must be investigated, or if anyone is injured.
- Do not abandon the vehicle without taking appropriate measures to protect and safeguard it.
In the event of fire, vandalism, theft, or disappearance of the vehicle, the Client agrees to immediately inform Easy Rent a Car Marbella of the facts and file the appropriate report with the authorities.
